Terms of use governing access to the DFT Academy e-learning platform

Summary: These Terms set out the conditions applicable to use of DFT Academy courses and the Platform.

Key provisions include: a minimum registration age of 18, a licence to course content for personal or internal professional use only (excluding resale), a general policy of non-refundable fees once a course has been accessed, and governance by the laws of Kenya.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern access to and use of the DFT Academy platform (the "Platform"), operated by DFT Consulting LLP, trading as DFT Group, of Manga House, 1st Floor, Kiambere Road, Nairobi, Kenya ("DFT Academy", "we", "us", "our"). By creating an account, enrolling in a course, or making payment for any course, you ("Learner", "you") agree to be bound by these Terms.

If you are enrolling on behalf of an organisation, references to "you" include that organisation, and by accepting these Terms you confirm you have authority to bind it.

Subject to your compliance with these Terms and payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the Content solely for your own personal or internal professional development. You may not:

5. Fees, Payment, and Refunds

5.1 Payment terms

Course fees are stated on the Platform at the time of enrolment and are payable in advance, unless otherwise agreed in writing. Payments are processed through our third-party payment provider(s). By making a payment, you also agree to that provider's applicable terms. We may change course fees at any time, but changes will not affect Courses you have already paid for. Corporate Clients enrolling multiple staff may be subject to separate invoicing and payment terms, as agreed in a signed corporate services agreement.

5.2 General refund policy

DFT Academy gives you direct access to online training content on payment. As a general rule, once a Course has been purchased and access granted, no refund is issued except as set out below. Please review Course requirements and content carefully before enrolling. If DFT Academy has to cancel a Course for any reason, we will refund 100% of the amount you paid for it. We cannot refund fees on account of changes in your personal or professional circumstances after enrolment.

5.3 Course access deadline

Each Course must be completed within 3 months of the registration date. This deadline cannot be extended, and no refund is issued for failure to complete a Course within this period.

5.4 Licence assignment

Course licences are assigned to a specific user and cannot be transferred or reassigned once issued. If a Course is mistakenly assigned to the wrong person, a new licence must be purchased for the correct user. A refund may be requested for the original licence under the conditions in Section 5.5.

5.5 Requesting a refund

Where a Learner wants to cancel their enrolment in good faith, we will consider a refund under these conditions:

Refund requests can only be made by email to info@dftconsult.com. DFT Academy may update this refund policy from time to time; the version published on the Platform at the time of your purchase applies to your enrolment.

6. Certificates and Accreditation

Certificates issued on completion of a Course confirm that you completed the stated training content and assessments on the Platform. Unless a Course page expressly says otherwise, certificates are evidence of training completion issued by DFT Academy; they do not constitute a professional licence, statutory qualification, or endorsement by any regulator, professional body, or government agency. You and your employer remain responsible for deciding whether a given Course satisfies any specific regulatory, licensing, or continuing professional development requirement that applies to you.

9. Intellectual Property

All trademarks, logos, course design, text, graphics, video, and other materials on the Platform are owned by, or licensed to, DFT Academy, and are protected under Kenyan and international intellectual property law. Nothing in these Terms transfers any intellectual property rights to you.

10. Disclaimer of Warranties

The Platform and Content are provided on an "as is" and "as available" basis. While we take reasonable care to ensure course content is accurate, current, and aligned with applicable Kenyan regulatory frameworks at the time of publication, we do not warrant that the content is error-free, complete, or suitable for every regulatory purpose, or that the Platform will be uninterrupted or secure at all times.

11. Limitation of Liability

To the maximum extent permitted by law, DFT Academy is not liable for any indirect, incidental, special, or consequential loss arising from your use of the Platform, including loss of profits, business, or data. Our total aggregate liability to you for any claim arising out of or relating to these Terms will not exceed the amount you paid for the relevant course in the 12-month period preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Kenyan law.

12. Termination

We may suspend or terminate your access to the Platform, without refund, if you breach these Terms, engage in fraudulent activity, or misuse the Platform. You may close your account at any time by contacting us; this does not entitle you to a refund of fees already paid, except as set out in Section 5.

13. Data Protection

Our collection and use of your personal data is governed by our Privacy Policy, published on the Platform, which forms part of these Terms by reference.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms will first be referred to good-faith negotiation between the parties, and if that does not resolve things within 30 days, will be subject to the exclusive jurisdiction of the courts of Kenya.

15. Changes to These Terms

We may update these Terms from time to time. Continuing to use the Platform after changes take effect means you accept the revised Terms. Where changes are material, we will notify registered users by email or platform notice.
